8. Estimates & Services

Estimates provided through the Site are non-binding until both parties sign a written work agreement. Final pricing depends on site conditions, materials selected, project scope, and any changes requested after the initial estimate. We reserve the right to decline any project for any reason.

9. No Warranty

THE SITE AND ALL CONTENT, MATERIALS, AND SERVICES PROVIDED THROUGH IT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. Landscaping outcomes depend on numerous factors outside our exclusive control, including but not limited to weather, soil conditions, irrigation practices, pest activity, and ongoing maintenance by the property owner. We make no guarantee as to the survival, growth, or performance of plants, sod, turf, or other living materials after installation.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Father & Son Landscaping, LLC AND ITS OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SITE OR OUR SERVICES, REGARDLESS OF WHETHER SUCH DAMAGES WERE FORESEEABLE AND WHETHER OR NOT WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT WILL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE EXCEED THE AMOUNT YOU PAID TO US, IF ANY, IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY.

15. Contractor & Licensing Disclaimer

Father & Son Landscaping, LLC operates as a licensed and insured landscaping contractor in the State of Florida. Photographs, project examples, plant recommendations, and pricing ranges shown on this Site are illustrative only and do not constitute a binding bid, warranty of results, or a professional horticultural, structural, or engineering opinion for your specific property. All work is performed only under a separate written agreement signed by both parties. Outcomes such as plant survival, drainage performance, paver settlement, and turf establishment depend on site conditions, irrigation, weather, soil, and ongoing maintenance, and cannot be guaranteed beyond what is expressly stated in that written agreement.
